## Privacy Policy (Datenschutzerklärung)

### 1. Swiss nDSG Compliance
We process data in accordance with the **Swiss Federal Act on Data Protection (nDSG)**. We only collect data necessary to provide the SatoriCheck service.

### 2. Third-Party Data Processors & USA Transfer
To provide our service, your data is transferred to and processed by the following providers, primarily in the **USA**:
- **Deepgram, Inc.:** For real-time audio-to-text transcription of the live pro function.
- **xAI (Grok)**: For "Smart Mode" social context analysis. Only the text of the fact-check claim is shared; no personal identifiers (email, IP) are transmitted.
- **Google LLC:** For Gemini AI analysis, Authentication (Google Auth), and Infrastructure (Cloud Run).
- **Stripe, Inc.:** For secure payment processing.

**Legal Basis:** We rely on the Swiss-U.S. Data Privacy Framework and Standard Contractual Clauses to ensure an adequate level of data protection for these transfers.


### 3. Data Storage & Rights
Generally, I do not store anything, as authentication is handled by google and all services are only temporary and deleted after use.
Your account data are stored in a secure PostgreSQL database on Google Cloud via their google authentication. You have the right to request information about your stored data, as well as its correction or deletion, at any time. I do not know anything about my users, I only see a number going up in my database when you sign up.
"Smart Mode" is optional and disabled by default. When enabled, your claim text is processed by gemini for claim context, then by Grok API to search for social media context. Then it goes back to gemini for factchecking. We do not store any API responses beyond your current session. Please refer to xAI’s , google ai's and deepgram's ai Privacy Policy for their specific data retention practices. 
Social Sharing: Verdict images are generated locally on your device; we do not store the content of your shares on our servers. We only collect anonymous aggregate data (e.g., which platform was selected) to monitor feature usage.
Pitch Deck Analysis: Uploaded pitch decks are encrypted in transit, processed entirely in-memory, and immediately permanently deleted after analysis without being used for AI model training.

## Terms of Service (AGB)

### 1. Service Description
SatoriCheck is an AI-powered assistive tool, as is and without warranty, operated by **Marketing Rüegger**. The service provides automated analysis of text and audio to assist in fact-checking through:
* **Text Fact-Checking:** AI-generated verdicts on submitted text.
* **Live Pro:** Real-time audio transcription and analysis.
* **Check Points (CP):** Virtual credits used to access these features.

### 2. AI Disclaimer & Limitation of Liability
* **Nature of Output:** SatoriCheck uses probabilistic AI models (Google Gemini) and automated transcription (Deepgram). You acknowledge that AI can "hallucinate"—generating outputs that appear factual but are incorrect or outdated.
* **No Professional Advice:** SatoriCheck is an informational aid. It does **not** provide legal, medical, or financial advice. Final verification remains the sole responsibility of the user.
* **Social Sharing:** You are responsible for any content you share. You agree not to obscure or remove the "AI-generated" disclaimer on shared images. We are not liable for how third-party platforms (e.g., X, LinkedIn) process your data.
* **Swiss Liability Shield (Art. 100 OR):** To the extent permitted by the Swiss Code of Obligations, liability for light and medium negligence is excluded. Marketing Rüegger is not liable for indirect damages, lost profits, or consequences arising from reliance on incorrect AI outputs.
* **Consent to Automated Processing:** By using SatoriCheck, you provide **explicit consent** to receive verdicts generated solely by automated AI processing. You acknowledge that Marketing Rüegger does **not** provide manual human review, second opinions, or forensic verification for these technical results.

No Financial Advice: The Pitch Deck Analysis module in particular is provided for informational purposes only and does not constitute financial, investment, legal, or tax advice. It is a technical demonstration of AI capabilities. You acknowledge that all analysis is generated by probabilistic Artificial Intelligence systems which may produce inaccurate, incomplete, or misleading results. Market data and competitor insights are estimates and not guaranteed facts. I prompt for primary sources and only verified facts but it can make mistakes.
Limitation of Liability: You agree that SatoriCheck and its operators shall not be liable for any investment decisions, lost profits, or business consequences resulting from the use of this service. You are solely responsible for conducting independent due diligence. The service is provided "AS IS" without warranty of any kind.

### 3. Check Points (CP) & Payments
* **Non-Refundable:** Check Points are non-refundable virtual credits with no cash value. They are forfeited upon account deletion.
* **Payments:** All transactions are processed securely via **Stripe** in Swiss Francs (CHF).
* **Fair Use:** Abuse of promotional offers or creating multiple accounts to claim signup bonuses is prohibited and may result in immediate termination.
