A Joint Resolution to amend the Constitution to alter the number of Representatives and Senators.


Be it resolved by the Senate and House of Representatives of the State of Firestone in Congress assembled,

SECTION 1. SHORT TITLE

This Joint Resolution may be cited as "An Amendment to Rejuvenate Democracy".

SEC. 2. EFFECTIVENESS

The text of the Constitution shall be amended effective immediately, but:

(1) the number of Representatives shall not be altered until the next election of Representatives in accordance with this amendment; and

(2) the number of Senators shall not be altered until the next election of Senators in accordance with this amendment, in which all eight Senators shall be elected, but—

(A) the four being elected having the least votes; or

(B) in the case of a default election, the four having obtained the least number of supports or signatures;

shall be replaced at the immediately following election, serving only one half of a term. But in the case of any tie affecting the disposition of Senators in those two classes under the aforementioned criteria, the Chief Court Justice shall, by a publicly transmitted means, randomly select the classes assigned to the individuals tied.

(3) Notwithstanding the preamble to the Constitution, this provision shall not be included in the text of the Constitution.

SEC. 3. SEVERABILITY

Should any part of this amendment be struck down or declared unenforceable, then that part of the amendment shall be considered severed from this amendment, and the rest shall remain in full force.

SEC. 4. AMENDMENTS

(a) Article I, section II, clause I of the Constitution shall be amended to read:

"I. The House of Representatives shall be recognized as the lower chamber of Congress and shall consist of nine citizens elected by the people of the State of Firestone."

(b) Article I, section II, clause II of the Constitution shall be amended to read:

"II. Representatives admitted during a regular election shall serve a term in accordance with clause VII. If there are below seven members within the House of Representatives, the Speaker of the House; or in the absence of the Speaker of the House, the Speaker pro tempore shall be mandated to hold a special election to fill the vacant seats. Before the begining of each term, the Governor of the State of Firestone will be obligated to host new elections to replace all nine representatives. Representatives shall not be limited in the number of terms of office they may serve unless barred from said office."

(c) Article I, section II, clause VII of the Constitution shall be created and read:

"VII. The terms of Representatives shall be from the 1st of January through the 31st of March, the 1st of April through the 30th of June, the 1st of July through the 30th of September, and the 1st of October through the 31st of December."

(d) Article I, section III, clause I of the Constitution shall be amended to read:

"I. The Senate shall be recognized as the upper chamber of Congress and shall consist of eight citizens elected by the people of the State of Firestone."

(e) Article I, section III, clause II of the Constitution shall be amended to read:

"II. Senators admitted during a regular election shall serve a term in accordance with clause X. If there are below six members within the Senate, the President of the Senate; or in the absence of the President of the Senate, the President pro tempore shall be mandated to hold a special election to fill the vacant seat. Before the beginning of each term, the President of the Senate will be obligated to host new elections to replace the four members of the chamber whose seat was not put up in the most recent regular elections. Senators shall not be limited in the number of terms of office they may serve unless barred from said office."

(f) Article I, section III, clause X of the Constitution shall be created and read:

"X. The terms of Senators shall be from the 1st of January through the 30th of June, the 1st of April through the 30th of September, the 1st of July through the 31st of December, and the 1st of October through the 31st of March."
