The Constitution of the Federated Communes of Sirkani

Preamble

We, the people of Sirkani,

Recognise the mistakes and oppression of our past;

Esteem those who work and have worked together to build our great nation;

Pledge solidarity and unity in order to realise an equal society for all Sirkanians.

We therefore, through the will of the people established by a democratic and equal vote, adopt this Constitution as the supreme law and framework of the Federation so as to chart our way forward in order to build a democratic and equal society in which all individuals live high-quality lives free of oppression and unjustified hierarchy.

The Federated Communes of Sirkani

The Federated Communes of Sirkani (henceforth the Federation) is a confederation of semi-autonomous communes within the nation of Sirkani overseen by a proportionally-elected council of represents from each semi-sovereign commune. It is founded on the principles of anarchism (the eradication of all unjustified hierarchies), communism (a classless, stateless society in which the means of production, distribution, and exchange are controlled by the community), equality, and bottom-up horizontal participatory democracy (a radical democracy in which the people command and the government or governing councils, not necessarily organised into a state, obey). Our aim to to create a prosperous, equal, non-discriminatory, non-oppressive, horizontally organised society, and as such our values are in support of the achievement of these goals.

To this end, all citizens of the Federated Communes of Sirkani pledge to protect these values, to promote equality, never to oppress, and to foster understanding, truth, and rationality.

The Supremacy and Framework of the Constitution

The Constitution of the Federation is the supreme law of the nation – all communes within it cannot contravene it and remain part of the Federation. It serves as the framework for the society to exist, organise itself, and govern itself.

Confederation and Sovereignty

Each commune within the (Con)Federation self-governing, autonomous, and sovereign to a degree. This means that they determine their own path, but are still subject to the Constitution and may be overruled by the will of the combined people of Sirkani under certain circumstances. To this end, if a commune decides to secede and forgo the privileges and aid provided by the community of the Federation, they may do so. They may also be evicted if found in contravention of the constitution and a 50% majority vote passes, or for another reason if a 75% majority vote passes. The Federation is also, itself, a sovereign nation, deriving its authority directly from the rule of the people. It shall have a proportionally-elected council who shall govern the nation when required, and have the capacity to enter into contracts and agreements with other sovereign nations. Democracy The democracy of the Federation will be a bottom-up, participatory, and horizontally structured democracy which promotes equality, self-governance, and political freedom. The mantra, so to speak, is that the people command the government, not the other way around. Each commune will elect a council for governance once every two weeks. It is important to know that this will be controlled by the people – the council is the body that shall carry out and embody the will of the people, not a body to control the people – rather, the other way around. The commune will also elect a proportional amount of members to the supreme council every month who will then govern the nation on a national level. Ministers or specific representatives may also be elected when required – for instance, members of military high command, or diplomatic representatives – on different and dynamic timescales, but no less often than once every three months. Individuals who are elected to the council shall be elected using the Single Transferable Vote. The vote shall be run by an independent, transparent electoral commission.

Powers and Duties of Communal Councils

It is the duty of the communal councils to oversee the day-to-day running of their respective communes, as well as to invest in furtherment of the commune, its people, as well as to aid other communes and provide public goods and infrastructure. The communal councils act as the vessel of the people’s will, and they should never seek to beguile the people by carrying out things that were not willed. If this ever occurs, such members should be voted off the council in the next election.

Powers and Duties of the Supreme Council

It is the duty of the Supreme Council to oversee national level affairs such as international diplomatic affairs, wealth redistribution (where necessary), national infrastructure and projects, facilitate relationships between communes, and further the will of the people of the nation as a whole. It is also the duty of the Supreme Council to ensure that all communes are heard and participate in the nation, as well as that all obey the values set out in the Constitution.
