Do's

  1. Clearly identify message as an Ad.
  2. Give physical location of business.
  3. Give them the ability to opt-out.
  4. While you can give options on an opt-out page, you must allow a blanket opt-out option.
  5. Honor opt-outs within 10 business days
  6. Monitor other's use of your name - responsible for hired help

Don't's

  1. Don't use false or misleading header info (Froms Tos and Reply-Tos).
  2. Don't Deceive in the subject line
  3. Don't spam me, bro!

Other Info

  • Each separate email in violation = penalties up to $16,000
  • Covers all commercial messages (as opposed to personal messages and transactional/relationship messages)
