Before the Iowa Supreme Court

Brewbaker v. District Court - Iowa Sup. Ct. No. 21-1630

Motion for 3 judge review (ammended)

Chad Brewbaker, a registered elector in the State of Iowa and Dallas County.

Dana Oxley is up for retention election. Acting under the false color of her office to conceal her own conduct from registered electors is consistent with her previous conduct.

Did Dana Oxley embezzle $7500 while on the high court?

Justice Dana Oxley was appointed in January 2020.

Iowa Code 602.10109 - Teaching law in Iowa is considered practice of law.

Iowa Code 602.1607 - Court employees shall not practice law.

Iowa Code 602.1608 - Salaries exclusive.

Iowa Code 602.1609 - Compliance with ethics law.

Oxley until at least May 2020 was illegally double dipping Regent salary during this PCR while aiding and abetting vigilante other restraint on Brewbaker's Regent educational services.

In April/March 2020 Oxley interjected herself to conceal Brewbaker being fradulently detained at the Polk County Jail pending the PCR and tortured with denial of medical aid by denying his Petition for Ceriorari to the Iowa Supreme Court without Iowa Code 602.1606 mandatory conflict disclosure she was still a Regent employee.

Since February 2020 Oxley has aided and abetted the Polk Clerk of Court's fradulent failure to docket and set for hearing Brewbaker's concurrent Petition for Certiori to the District Court for Polk County which was explicitly incorporated in the Iowa Supreme Court Certiorari.

Is Dana Oxley otherwise conflicted?

https://www.legis.iowa.gov/publications/fiscal/salaryBook search "Jarvey" shows U.S. Judge John Jarvey was corruptly on Regent payroll without disclosure to the 8th Circuit. Dana Oxley as Regent employee was complicit in writing the checks to Jarvey.

The U.S. Courts investigation on Jarvey's nondisclosure of Regent payments didn't cause him to resign until March 2022 - making the payments material to Brewbaker's concurrent Federal habeaus petitions during the PCR.

Oxley boasted of close ties to Jarvey in her application to the Iowa Supreme Court - materially omitting the $6,000 a year payments.

Oxley also fradulently dismissed as "discressionary" the timely direct appeal as matter of right on Brewbaker's 2017 Iowa False Claims Act petition regarding a $100m municipal tax bribe which was fradulently dismissed without required written consent of the Iowa Attorney General under the Iowa False Claims Act by Chief Judge Huppert.

Oxley - a part time Regent employee at the time of Brewbaker's 2017 Iowa False Claims Act petition - committed an act of OSHA whistleblower retaliation - the petition on Regent embezlement included secret Wells Fargo loans to defruad Regent bond underwriters - Regent bonds are SEC regulated securities. Brewbaker is now owed OSHA whistleblower damages on top of 8th Ammendment overages.

Was Brewbaker a victim human research subject?

Today it was uncovered Brewbaker was a human test subject by Oxley, the University of Iowa, and the County Attorney Association.

Recall in 2017 Brewbaker filed an Iowa False Claims Act Petition on Regent embezzlment - including University of Iowa embezzlment to off campus clinics outside Iowa Code 23A.2 and private attorneys not authorized by the Governor's Execuitive Council under Iowa Code 13.7.

The State admitted it in a press release. The research software wasn't designed or calibrated for calculating bond in Iowa quasicriminal cases - resulting in the obcene bond over $20k on Brewbaker set by the Magistrate Court for Polk County to fradulently detain him during the PCR.

The Arnold Foundation report is damning. Not for it's contents but for omission all 5th Judicial Disrict Detainees were also used as University of Iowa's test subjects for the Arnold Foundation.

We also now know why the former Marshall County Attorney and member of the Iowa County Attorney's Association quashed the testimony of the Department of Inspections and Appeals Director last month. She was in on the human bail experimentation that caused Brewbaker to be wrongfully detained for six months disrupting the PCR.

Wherefore,

Oxley's order should be striken for undisclosed conflict of interest. Iowa State University shall cease vigilante other restraint of Brewbaker's Ph.D. program in Computer Engineering.

Within 10 days:

  • The IDOC Director shall give Brewbaker a copy of the Arnold Foundation bail software for forensic analysis.
  • The State shall turn over Brewbaker's detainee medical records.
  • Polk and Dallas County shall answer who is acting as fiduicary for Iowa Code 125/229 detainee assets.
  • Judge Larson's court reprorter shall turn record of the 28 March 2019 hearing to the Polk Clerk of Court.
  • The State and Polk County shall answer Brewbaker's concurrent February 2020 Petition for Certiorari to the District Court for Polk County contesting a six month magistrate court detainment and discrimination in medical services.
  • Oxley will return the $7,500 with judicial branch interest since May 2020 or answer to the Iowa Auditor why she should uniquely receive a second paycheck.
  • The Iowa Insurance Commissioner shall cure Oxley's SEC violation by making known to Regent bond holders the secret Wells Fargo loans to conceal Regent debts, and to Dallas County public body bond holders - City of Waukee, Waukee Schools, Clive, Urbandale, West Des Moines, and Adel - the $100m municipal tax bribe defrauding $177m from the property tax base.

Within 20 days:

  • All counties in Iowa shall review detainee pharmacy formularies for compliance with the Americans with Disabilities Act then voluntarily disclose remediations plublicly and via iowa.investigation@usdoj.gov. If the U.S. Department of Justice has futher concern it should notify the State Court Administrator.

  • The Iowa Attorney General communicate to county attorneys and the Iowa General Assembly his Federal Dunn v Leath settlement voiding the vague "annoying" language of Iowa Code 708.7 under the Iowa Constiution supremecy clause.

  • All counties in Iowa shall designate who is fiduicary for Iowa Code 125/229 detainee assets, and who will take claims on 125/229 detainee assets liquidated without the honest services of a fiduicary.

  • The Iowa Department of Inspections and Appeals shall report on the Iowa Attorney General's Iowa Code 17A.17 compliance regarding ex-parte opinions "jurisdictionaly" dismissing abuse claims without investigation at DIA, DCI, SPD, IDOC, and ICRC.

  • The Iowa Department of Inspections and Appeals shall issue 17A guidence for review of contested attorney fee awards.

  • The Iowa Appeals Board will respond to Brewbaker's June 2021 tort claim on 8th Ammendment overages.

  • Iowa State Auditor Rob Sand and Iowa Attorney General Thomas John Miller respond to Brewbaker's 2017 Iowa False Claims Act petition on Regent embezzlement and 2017 Iowa False Claims Act petition on $100m in municipal tax bribes. The Audit Report on Iowa State University will be ammended with material disclosure of staff resources wasted by Iowa State University attempting to compartmentalize the embezzlement via the Workday software system so registered electors can make their on decision if Sand and Miller shall remain in office.

  • The Iowa Board of Regents will place in escrow all settlment money from cases where Jarvey presided while on Regent payroll and notifiy opposing parties so they can make settlment fraud claims.
