Interview with Attorney Marco Mellone — Italian Citizenship (Jure Sanguinis Case)
Outside the Court of Cassation — April 2026
Interviewer (Romina):
When I heard you speaking earlier, Marco, you mentioned that the Constitutional Court might effectively overturn the jurisprudence of the Court of Cassation. Could you explain that in more practical terms, for those of us who are not lawyers?
Marco Mellone:
The issue is actually quite straightforward. I emphasized the importance of confirming the jurisprudence of this Supreme Court, which is the only authority tasked with interpreting Italian law in a uniform way.
This Court—where we are today—has consistently held that descendants of Italians are Italian citizens from birth, and that they do not lose their citizenship without their own consent.
