The Agreement between my roommates and myself.

Roommate Agreement

Purpose

The purpose of this document is to form an agreement between the lessees of the property located at 1047 Roland Road, Cleveland, Ohio. These people include John Cleaver, Matthew Richter, Connor Balin, and James Moffitt (hereafter, "the residents". The execution of this roommate agreement does not alter the joint liability of the tenants under the rental contract with the landlord. However, it may be used if a dispute among the roommates arises.

Length of Contract

This contract is valid for the term of the property's lease, June 15th, 2012 to June 15th, 2013, at which point it may be renewed at the option of the residents.

Costs of Residency

Rent

The residents agree to divide the cost of rent evenly among them, with the exception of the month of July, during which it will be divided evenly between Richter, Cleaver, and Balin. Any resident who does not pay any or all of their portion of the rent will be liable to the landlord or to the residents who pay any amount due for the defaulting resident. Each resident's portion of the rent will be paid to Matthew Richter on the last day of the month before the month for which that rent is due (i.e. If July's rent is due to the landlord on July 1st, each resident should have their portion paid to Matthew Richter by June 30th.).

Should a resident terminate his residency before the end of the term of the lease, he will still be liable for his rent for the remainder of the lease term.

Security Deposit

A security deposit in the amount of $1450 has been paid in equal amounts by all residents. At the end of the residency period, the residents will divide the refund of the security deposit in equal amounts. When a specific roommate is clearly responsible for fees or damage to the premises-- including late fees, repairs, and cleaning costs-- That roommate will pay full fees and damages. The roommates agree to share equally in the cost of all other fees and damages charged.

Utility Bills

The property will maintain the following utilities: Electricity, Water, Natural Gas, and High Speed Internet. With the exception of water, all of these utilities will be in the name of Matthew Richter. Water is in the name of the landlords. The cost of each of these utilities will be divided evenly among all of the residents unless it is determined that one of the residents is using a significant amount of one or more utilities (i.e. a resident owns a high power consumption device, such as a personal refrigerator), at which point another distribution of the cost should be agreed upon by the residents.

Each resident will pay their portion of the utility bills to Richter before the date on which the bill is due. Should a brother not pay his portion of a utility bill on time, he will be solely responsible for any resulting late fee unless the remainder of the residents agree to distribute the late fee evenly.

House Supplies

The residents agree to divide evenly the costs of any supplies that are purchased for the use of all residents. These materials include, but are not limited to, soap, paper towels, toilet paper, cleaning supplies, and garbage bags.

Responsibilities of Residents

Private Living Spaces

Each resident is responsible for the state and cleanliness of their individual private living space. These spaces will be kept in a state that is presentable to 3rd parties (Visitors, parents, or the landlord).

Dishes

Each of the residents agrees that he will be responsible for his own dishes. All dishes will be cleaned in a reasonable amount of time after use (1-2 days). If the dishwasher is functional, residents may opt to place used dishes in it. If a resident discovers that the dishwasher is full, he will run the dishwasher. It he discovers that it is clean, he will empty it.

Trash and Recycling

The residents agree that they will take turns removing garbage and recycling from the residence. These articles will be placed on the curb on Monday evening after 5PM in accordance with Lyndhurst City Ordnances[1].

Other Household Duties

The residents agree that they will take turns performing any other household duties including, but not limited to cleaning the bathrooms, cleaning the kitchen, cleaning the common areas.

Courtesy to Other Residents

Noise

The noise level in the residence will at all times comply with Lyndhurst City Ordinances. Residents agree that they will at no time create an undue amount of noise that would disturb other residents or neighbors.

Notification of Absence

For the safety and protection of all residents, if a resident is going to be away from the residence for a long period of time (more than three days), he should notify the rest of the residents as to the length of his absence and his destination(s).

Parties

Residents holding parties will notify all other residents at least one week in advance. They will be responsible for the conduct and behavior of any guests at the party. They will clean the areas in which the party was held after the party is over. Parties held during quiet hours need the approval of all residents.

Guests

If a resident wishes to have a guest stay at the house, he should notify the rest of the residents at least a week in advance if possible. If a resident wishes to have a guest stay more than three days, he will get the permission of the rest of the residents.

Each resident is responsible for the conduct and behavior of his guests. Guests will not unreasonably disturb other residents. Guests should stay in the room of their host unless all other roommates agree that the guest may stay in a shared area.

Quiet Hours

All residents agree to observe quiet hours for sleep, study, and other purposes. Quiet hours are designated as 10PM-8AM Sunday through Thursday.

Private Property

Residents are expected to respect the property of other residents. Private property will only be borrowed with the permission of its owner and will be returned in a reasonable amount of time. If any resident damages the property of another resident, intentionally or otherwise, the former will reimburse the latter for the value of the damaged property.

Joint Property

Some items will be owned jointly by all residents. The cost of these items will be split evenly by all residents. At the end of the residency period, the ownership of the property will be distributed between all of the residents in a manner to be agreed upon by the residents.

Smoking

Smoking will not be allowed in the residence.

Resolution of Disagreements

If a resident ever has a disagreement with another resident, whether covered under the terms of this agreement or not, that resident will first confront the resident with whom they have a disagreement. If the disagreement is not resolved, the resident may then have the disagreement arbitrated by the remaining residents.
