My HoA's struggle with window mullions and the homeowner who dared remove them.

February 18, 2016

  • A carriage homeowner communicated with the Board via telephone regarding a request to remove the mullions from windows in his home.

September 15, 2016

  • The Board discussed the Attorney response regarding a Carriage Homeowner who has removed the mullions from his windows. The Association has asked that these be reinstalled, as they are an exterior component of the home. The letter from the Association attorney was approved as written.

October 20, 2016

  • The attorney recommendation for discussions with a homeowner who has removed the mullions from the windows was reviewed. REDACTED 1 will respond to the attorney that the Board would like to speak to the homeowner as a group at the November Board Meeting.

November 17, 2016

  • Homeowner REDACTED 2 attended the meeting to discuss the mullions that were removed from the windows in his home. He proposed a compromise to the Board’s request that they be reinstalled. REDACTED 2 left the meeting after both the Board and he shared their comments. The Board will discuss at the meeting and respond back to REDACTED 2 in a timely fashion.

  • A motion was made to deny REDACTED 2’s request for installing window mullions in only 6 windows at his home in lieu of window mullions in the entire home. All were in favor and the motion passed.

December 16, 2016

  • The Board discussed the potential law suit regarding the Carriage Homeowner who has removed the mullions from the windows of their home. Their attorney has contacted our attorney asking for minutes, correspondence and documents regarding the Association. After a lengthy discussion regarding the potential cost of a law suit, the Board asked REDACTED 1 to prepare an opinion survey to be sent to homeowners regarding their input regarding the mullion issue, as the Board realizes their fiduciary responsibility to all 237 members of the Association.

January 19, 2017

  • The Mullion Opinion Surveys were reviewed. The Board will have recommendations on the results at a later date. REDACTED 1 will contact the Association’s Attorney regarding discussions with the homeowner’s attorney, in the hopes that a resolution can be reached without a law suit. It is this Board of Directors intent to avoid a law suit.

May 22, 2017

  • Homeowner REDACTED 3 discussed what he has heard in the community regarding the litigation. A homeowner removed the mullions from his home without Association approval. He was notified via mail that he needed approval and sent the appropriate paperwork. The request was not approved based on the Declaration, and the homeowner was asked to put the mullions back in the windows. As a result the homeowner has filed a lawsuit against the Association. REDACTED 3 expressed his concern that the Board reconsidered their decision based on the lawsuit and shared a history of mullions in the community.

June 15, 2017

  • REDACTED 4 made a motion to approve the modifications to the settlement regarding the mullions, two were in favor and one opposed and the motion carried. REDACTED 1 will contact the Attorney to make the changes.
