Thank you for your interest in contributing to qg. The intellectual property rights for piet-cosmic-text are owned by the Project Leadership ("Leadership", "We" or "Us"). In order to clarify the intellectual property license granted with Contributions, this contributor agreement ("Agreement") documents the rights granted by contributors to Leadership. This Agreement is for the protection of Contributors as well as Leadership. It does not change your rights to use your own Contributions for any other purpose.
Please read this Agreement carefully and sign it with your GitHub credentials to make it legally binding.
"You" (our "Your") means the copyright ownere or legal entity who submits the Contribution to Us. For legal entities, the entity making a Contribution and all other entities that control, are controlled by, or are under common control with that entity are considered to be a single Contributor. For the purposes of this definition, "control" means (i) the power, direct or indirect, to cause the direction or management of such entity, whether by contract or otherwise, or (ii) ownership of fifty percent (50%) or more of the outstanding shares, or (iii) beneficial ownership of such entity.
"Contribution" means the work of authorship, including any modifications or additions to an existing work, that is intentionally submitted by You to Us.
"Copyright" means all rights protecting works of authorship owned or controlled by You.
"Material" means the work of authorship which is made available by Us to third parties. After You submit the Contribution, it may be included in the Material.
Subject to the terms and conditions of this Agreement, You hereby grant to Us and to recipients of software distributed by Us a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to:
- Reproduce and prepare derivative works of the Contribution.
- Display publicly and distribute copies of the Contribution in any form.
- Sublicense and distribute your Contributions and any derivative works created from your Contributions in any form.
Subject to the terms and conditions of this Agreement, You hereby grant to Leadership and to receipients of software distributed by the Foundation a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable (except as stated in this section) patent license to make, have made, use, offer to sell, sell, import, and otherwise transfer the Work, where such license applies only to those patent claims licensable by You that are necessarily infringed by Your Contribution(s) alone or by combination of Your Contribution(s) with the Work to which such Contribution(s) was submitted. This license is granted only to the extent that the exercise of the licensed rights might otherwise infringe such patent claims; and provided, however, that this license is granted subject to compliance with Section 4.
Based on the grant of rights in Sections 2 and 3, if We include Your Contribution in a Material, We may license the Contribution under any license, including copyleft, permissive, commercial, or proprietary licenses. We may do so without additional consideration or obligation of any kind to You or any third party.
You represent that you are legally entitled to grant the above license. If Your employer(s) has rights to intellectual property that You create that includes your Contributions, You represent that you have received permission to make Contributions on behalf of that employer or that Your employer has waived such rights for Your Contributions to Us.
THE CONTRIBUTION IS PROVIDED "AS IS". MORE PARTICULARLY, ALL EXPRESS OR IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT ARE EXPRESSLY DISCLAIMED BY YOU TO US. TO THE EXTENT THAT ANY SUCH WARRANTIES CANNOT BE DISCLAIMED, SUCH WARRANTY IS LIMITED IN DURATION TO THE MINIMUM PERIOD PERMITTED BY LAW.
You are not expected to provide support for Your Contributions, except to the extend that You desire to prodive support.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL YOU BE LIABLE FOR ANY LOSS OF PROFITS, LOSS OF ANTICIPATED SAVINGS, LOSS OF DATA, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL AND EXEMPLARY DAMAGES ARISING OUT OF THIS AGREEMENT REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.
You agree to notify Leadership of any facts or circumstances of which you become aware that would make these representations inaccurate in any respect.
- This Agreement sets out the entire agreement between You and Us for Your Contributions to Us and overrides all agreements or understandings.
- If You are We assign the rights or obligations under this Agreement, the assignee must agree in writing to abide by all terms and conditions in this Agreement.
- The failure of either party to require performance by the other party of any provision of this Agreement in one situation shall not affect the right of a party to require such performance at any time in the future.
- If any portion of this Agreement is found to be unenforceable, the remaining portion of this Agreement will remain in full force and effect and the unenforceable portion will be replaced with a provision that is as close as possible to the effect of the unenforceable portion but is enforceable.
