XBR Network

XBR Network Terms of Service

Preamble

The XBR test network ("network"), as its name implies, is provided solely for the purpose of testing the XBR technology and applications developed using it, primarily for participants of the IDMA online competition. It is not intended for any use in production applications.

The XBR test network is provided by Crossbar.io GmbH of Erlangen, Germany.

Grant of Access

Registration is possible for any natural or legal person ("user"), where each account with the network needs to be held by one natural or legal person. Persons need to be of legal age.

Access to the XBR test network is granted to any successfully registered user, where acceptance of these terms is part of the registration.

Availability of the XBR test network is on a best effort basis by Crossbar.io GmbH. The network may periodically be unavailable, e.g. in order to run updates or other maintenance or due to bugs. The XBR technology stacks is under active development, and none of the functionality provided at the time of joining is guaranteed to be developed further, remain unmodified, or continue to be available at all.

Crossbar.io GmbH reserves the right to remove network membership and network access at any time without reason for general participants.

For IDMA participants, Crossbar.io GmbH reserves the right to remove their network membership and network access at any time if there is abusive behaviour or other serious violations of the code of conduct.

Code of Conduct

Users should be reasonable and considerate in their usage of the XBR network. Any abuse, e.g. intentionally causing large amounts of traffic in order to block the network, will result in immediate removal of network membership and access to the network.

Errors in code or deployment, or other behaviour which unintentionally causes usage or other effects similar to abusive behaviour will result in removal of network membership and access to the network if they are not immediately fixed upon notification by Crossbar.io GmbH and/or reoccur with great frequency.

Any use of the XBR network for production applications, i.e. any application which is used commercially or persistently, offered to the general public for use, or otherwise not run as strictly limited test deployment, is not allowed.

Test usage may not include any usage where damage to persons or property may occur, or where financial losses due to bugs, non-availability of the network or other technical problems or changes in connection with the XBR technology stack are possible.

Responsibility for avoiding these prohibites usages rests with the users.

Data Collection and Usage

During joining the network and during subsequent participation in it, some data is collected and stored.

Due to how the network, and the entire XBR technology stack works, a part of this information is necessarily stored on a public blockchain. The core of the blockchain, of course, is that it is immutable, i.e. that nothing stored on it can ever be erased as long as the blockchain remains accessible.

The information stored on the blockchain is the technical minimum required. It does not include your email or any of the information you provide as part of your member profile. It does include your wallet address, the time you joined the network, the time you join and leave data markets, you registering APIs and catalogues, and the payment channels that are required for secure payment within data markets. (See the technical documentation for the precise information stored.) None of this information directly identifies you, but it may be possible to attribute an account to you e.g. based on your usage of the wallet in other contexts where it is linked to personally identifying information.

By joining the network and by its use you accept that this minimal information becomes public and will remain so. Crossbar.io does not have control over the Ethereum blockchain or any of the public Ethereum test blockchains. As an analogy, think of your consent like that of having some information published in a newspaper with a print edition, where it will also always remain accessible to the public.

We also require other information, such as an email address, which does not get stored on the blockchain. You can request deletion of this at any time (though deletion of some information will also require closing your member account). Our general approach here is to store what is necessary for the running of the network and for analytics. For the latter we try to minimize retention. None of the information you provide is ever transferred to third parties except for where these store or process it under our direction. We reserve the right to transfer aggregates and other analytics for the data to third parties, provided that such does not allow conclusions about individual users.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Jurisdiction

The parties submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the courts of the Federal Republic of Germany, specifically the courts of Erlangen.
