Hello.. I am working on building a Node.JS hosting service..further down the road, the ambition is to create a component-based platform to compete with WordPress. First step is the hosting-type infrastructure. I don't see a good way to advertise this service without showing the actual Node.JS logo on my home page.
My concern is, the way that the trademark policy is worded, it looks like you may just decide to sue anyone who is using the logo and doing something like Node.js hosting or virtual machines. And actually it seems like that would almost be a good idea, since Joyent is competing in that space.
So this seems a bit of a conflict of interest. Anyway, I hope you will let me use the logo. If not, I will at least have to write Node.JS or something very similar otherwise people won't know what I am talking about.

Thank you for the inquiry. We can let you use the hosting agreement as desired, but in order to do so you will have to sign a free license agreement which leaves you open to Joyent's decision to decline renewal at some point or ask for different terms.
You can use "node.js" as long as "node" is not part of your domain or the name of your business or product(s). You can use it in a nominative fashion, e.g. "powered by Node.js".
Hopefully this clears things up for you.

On the off chance that Mr. Dahl actually is interested in this or wants to comment, I am sending him a copy.
The reason I am creating this "Node.JS hosting service" (which I intend to name Cure) is so that I can help make it easier for people to get started with Node.js by providing a preconfigured VPS with Node.JS via git, git, CoffeeScript, vim configuration for CoffeeScript, MongoDB and Express already installed and running taking advantage of the new cluster feature. Also I want to use that to fund my own open source development effort of a related component-based content and data management system built on Node.
Also, when you say that I cannot use Node as the name of the product, since "Node.js Hosting" is the name of the product, does that mean you want me to change it to "Hosting powered by Node.js"? That isn't really a good description of what I am doing. LOL.
Can you send me the agreement? Also when you say 'use the hosting agreement as desired' does that mean I can show the logo on the home page (if I sign the agreement)?

Can you send us a list of all planned uses of Node and the logo so we can insert those into the agreement?

I might be able to try to do that, to list all of the planned uses. On the other hand, it looks like it may be easier to come up with a code word in the development community or an alternate phrase that does not use the words "Node" or "Node.js" so that this issue can be avoided entirely.
