What does duty of care involve?

Everyone within your workplace, including yourself, has a duty of care to ensure that they work in a manner that promotes safety and prevents harm to themselves and those around them. A duty of care may be legally bound, i.e. within your contract, or a moral/ethical consideration that you should consider throughout your work. A duty of care involves doing everything within your capability to protect the health and safety of yourself and others in the workplace.

Who does not hold a duty of care on a construction site?

  • A person conducting a business or undertaking (PCBU) – this may include authorities, contractors as well as managers and manufacturers. There may be more than one PCBU, and they will share the primary responsibility for workplace health and safety

Your employer’s responsibilities regarding a duty of care are likely to be more related to the workplace in general and ensuring that everyone is aware of any relevant legislations and regulations.

General duty of care requirements might include:

  • Providing and maintaining workplaces
